1. Accepting these terms

By visiting Hookwise, creating an account, using a tool, reading or posting community content, or otherwise using the site, you agree to these Terms of Service and the policies linked below. If you do not agree, please do not use Hookwise. If you use Hookwise for another person or organization, you confirm that you have authority to accept these terms for them.

2. Eligibility and accounts

Hookwise is intended for people age 13 and older. We do not knowingly invite children under 13 to create accounts or submit personal information. If you are under the age of majority where you live, use Hookwise with the involvement and permission of a parent or legal guardian.

Keep your account information accurate and protect your sign-in details. You are responsible for activity that happens through your account, unless you promptly tell us about unauthorized use. Do not use another person's account or create an account by pretending to be someone else.

3. The free Hookwise service

Hookwise is currently a free fishing community and tools platform. The current experience includes fishing tools, guides, articles, community discussions, questions, photos, profiles, fishing logs, trip plans, saved knowledge, lessons, and AI-assisted fishing insights. Ira Spicer may add, remove, limit, or change features as the site develops.

We work to keep the site useful, but we do not promise that every page, record, tool, or feature will always be available, accurate, uninterrupted, or preserved. A feature may be unavailable during maintenance, technical problems, safety concerns, or other changes to the platform.

4. Fishing tools and AI guidance

Hookwise tools, articles, species information, recommendations, calculators, and AI output are general educational information for anglers. They are not a substitute for current regulations, a fishing license, local knowledge, weather alerts, waterway notices, medical advice, emergency services, or your own judgment.

Conditions change. AI output can be incomplete, outdated, or wrong, and it may not reflect live weather, water levels, closures, hazards, or regulations. 5. Community and member content

You may submit fishing reports, photos, questions, comments, recipes, locations, techniques, catch details, and other material. You keep ownership of content you create, but you must have the rights and permissions needed to share it. Do not upload someone else's photo, personal information, or private message without permission.

Content you place in community areas can be viewed by other visitors and may be copied, saved, shared, or discussed outside Hookwise. Think carefully before including an exact secret spot, phone number, home address, license information, or other sensitive detail. Fishing logs and saved records are intended for account use unless you choose a sharing feature, but no online service can promise absolute privacy.

6. Permission to display member content

When you submit content, you give Ira Spicer and the service providers that help operate Hookwise a non-exclusive, worldwide, royalty-free permission to host, store, reproduce, format, display, and distribute that content as needed to run, moderate, improve, and explain the service. This permission does not transfer your ownership and ends for ordinary display when you remove the content or close your account, except where copies are needed for backups, security, legal records, or content that other people already copied.

Use the available controls to remove content where they exist, or email hello@hookwisehq.com with the page or post details. We will review the request, but removal may not be immediate or technically possible in every copy.

7. Acceptable use

Use Hookwise lawfully and in a way that helps other anglers participate. You may not:

• Harass, threaten, stalk, demean, or target another person, including through hate or identity-based attacks.
• Post or encourage illegal activity, dangerous conduct, violence, fraud, malware, or instructions that put people or wildlife at unreasonable risk.
• Publish private information, doxxing material, stolen content, or an exact location someone asked you to keep private.
• Spam, scrape, flood, manipulate engagement, impersonate another person, or use Hookwise to promote unrelated services without permission.
• Infringe copyright, trademark, privacy, publicity, or other rights, or upload content you do not have permission to share.
• Probe, reverse engineer, interfere with, or bypass security controls for the site or its tools.

8. Moderation and account actions

Ira Spicer may review, refuse, limit visibility of, edit for formatting, or remove content that appears to violate these terms, the Community Guidelines, or the safety of the community. We may warn, restrict, suspend, or terminate access to an account or feature. We may preserve information and cooperate with lawful requests when necessary to protect people, the service, or legal rights.

We do not promise to monitor every post, identify every unsafe statement, or resolve every disagreement. If you see a problem, email hello@hookwisehq.com with the page address and a short explanation.

9. Hookwise intellectual property

The Hookwise name, logo, page design, original text, original graphics, software, tools, and other materials provided by Hookwise belong to Ira Spicer or are used with permission. These terms give you a limited, personal, non-transferable permission to use the service for its intended purpose. Do not copy, sell, republish, frame, extract, or create a competing service from Hookwise materials without written permission.

10. Third-party links and affiliate relationships

Hookwise may link to third-party websites, products, content, services, or tools. Those providers control their own availability, terms, privacy practices, prices, and safety information. Review their policies before sharing information or making a purchase. Hookwise may receive a commission from qualifying outbound links without changing your purchase price. 11. Disclaimer of warranties

To the fullest extent permitted by law, Hookwise is provided on an “as available” and “as is” basis, without warranties of any kind, express or implied. Ira Spicer does not warrant that the service will be uninterrupted, secure, error-free, current, complete, fit for a particular purpose, or free of harmful code. No fishing result, catch, product performance, species identification, or safety outcome is promised.

Nothing in these terms excludes a warranty or right that applicable law does not allow to be excluded.

12. Limitation of liability

To the fullest extent permitted by law, Ira Spicer and the service providers that support Hookwise will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, opportunities, or costs arising from your use of or inability to use the service, member content, AI output, fishing decisions, third-party links, or changes to the platform. This section does not limit liability that applicable law does not allow to be limited.

13. Your responsibility for claims

To the extent permitted by law, you agree to protect and reimburse Ira Spicer and the service providers supporting Hookwise for claims, losses, liabilities, and reasonable costs arising from your content, your misuse of the service, your violation of these terms, or your violation of another person's rights.

14. Florida law and venue

Florida law governs these terms, without applying conflict-of-law rules that would require another state's law. Unless applicable law requires a different forum, disputes related to Hookwise or these terms will be brought in the state or federal courts located in Duval County, Florida, and you consent to that venue and jurisdiction.

15. Changes to these terms

We may update these terms as Hookwise changes. The updated version will appear on this page with a new effective date. If you continue using Hookwise after an update takes effect, you accept the updated terms. For important changes, we may also highlight the change within the service when practical.
